Terms of Use

These Terms of Use (these “Terms”) govern your access to and use of the Photo Scanner mobile application (the “App”), and any related services, features, and content provided by Photo Scanner (collectively, the “Service”). By accessing, downloading, installing, or using the App or Service, you agree to be bound by these Terms. If you do not agree to these Terms, do not use the App or Service.

1. Introduction.

   The Photo Scanner App provides document scanning, editing, format conversion (PDF, JPG, TXT via OCR), and document management features. The App is currently available for iOS only; These Terms form a binding contract between you and Photo Scanner regarding your use of the App and Service.

2. Authorized Users.

   You may use the App only in compliance with applicable local, national, and international laws. If you are under the age required by local law to form a binding contract (commonly 18), please do not use the App. By using the App you represent that you are at least that age and have authority to accept these Terms.

3. Features; Subscriptions; Billing.
   1. Core Features. The App’s main features include: document (Document) scanning, ID card scanning, passport scanning, QR code scanning; editing tools (crop, rotate, contrast, add signatures, text/image/date/watermark/footer annotations, freehand markup); conversion to PDF, JPG, and TXT (OCR); and document management (rename, merge, create folders, move, search, sort, share).
   2. Subscription Plans. Photo Scanner offers subscription-based access to certain premium features. Available paid plans are listed below (all prices in USD):

   3. Free Trial. The weekly subscription may be offered with a 7-day free trial for first-time subscribers only. The free trial begins when you confirm the subscription through the App Store. If you do not cancel before the trial period ends, your subscription will automatically convert to a paid subscription and your App Store account will be charged the applicable subscription fee.
   4. Billing and Renewal. Subscriptions will automatically renew at the end of each billed period (weekly or yearly) unless auto-renewal is turned off at least 24 hours before the end of the current period. Payment is charged to your Apple ID account. You can manage and cancel subscriptions through your Apple ID account settings: open the App Store app, tap your profile, then tap Subscriptions.
   5. Fees, Taxes & Refunds. You are responsible for all applicable taxes and fees. All purchases, including subscriptions and in-app purchases, are processed by Apple (not by Photo Scanner). Refunds are subject to Apple’s refund policies. If you have questions about billing you should contact Apple Support; we can assist but we do not control Apple’s billing systems.
   6. Trial Eligibility & Promotional Offers. Photo Scanner reserves the right to determine whether you are eligible for a free trial or promotional offer and to modify or terminate any free trial or promotion at our discretion.
4. Changes to the Service or Terms.

   Photo Scanner may modify these Terms or change, suspend, or discontinue the Service (or any part of it) at any time. If we make material changes to these Terms, we will provide notice (for example, by posting the updated Terms in the App). Continued use of the Service after such changes constitutes your acceptance of the updated Terms.

5. Limited License.

   Subject to your compliance with these Terms, Photo Scanner grants you a limited, non-exclusive, non-transferable, revocable license to use the App on compatible iOS devices for your personal, non-commercial use.

6. Ownership; Proprietary Rights.

   The App, the Service, and all content, features, and functionality (including all intellectual property rights) are and will remain the exclusive property of Photo Scanner or its licensors. You shall not copy, modify, create derivative works of, publicly display, or otherwise exploit any part of the Service except as expressly permitted in these Terms.

7. Restrictions.

   You agree not to: (a) use the Service for illegal purposes or to violate these Terms; (b) attempt to gain unauthorized access to the Service or other users’ accounts; (c) upload or distribute malware or any content that interferes with the Service; (d) attempt to reverse engineer, decompile or otherwise attempt to derive source code from the App; or (e) circumvent any usage limits or other measures intended to protect the Service.

8. Your Content.
   1. Prohibited Content. You shall not create, upload, transmit, or share Content (including scanned documents, images, audio, video, or text) that: (i) violates applicable law; (ii) infringes third-party rights (intellectual property, privacy, publicity); (iii) is unlawful, harmful, abusive, defamatory, obscene, pornographic, or otherwise objectionable.
   2. License to Your Content. By uploading, importing, or creating Content through the Service (“Your Content”), you grant Photo Scanner a worldwide, non-exclusive, royalty-free, sublicensable license to use, reproduce, store, transmit, and display Your Content solely to provide the Service and to improve the Service (including aggregated, anonymized analysis). Photo Scanner will not publicly publish or share your scanned documents outside the Service except as described in our Privacy Policy or with your consent.
   3. Representations and Warranties. You represent and warrant that you have the rights necessary to provide Your Content and that your Content does not violate third-party rights or applicable law. You are solely responsible for Your Content.
9. Identity Authentication.

   Photo Scanner may use email, device identifiers, or third-party services to authenticate users. Authentication is not a guarantee of identity. You authorize Photo Scanner to perform identity checks or other verifications if required for security or fraud prevention.

10. User Account Information.

    If you create an account, you agree to provide accurate, current, and complete information. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account. Notify Photo Scanner immediately of any unauthorized use of your account.

11. Communications; Notice.

    You consent to receive electronic communications from Photo Scanner (for example, emails or in-app messages). Notices from Photo Scanner will be effective when sent. Legal notices to Photo Scanner should be sent to the address below.

12. Feedback.

    If you submit suggestions, ideas, or feedback, you grant Photo Scanner a perpetual, irrevocable, royalty-free license to use such feedback for any purpose.

13. Third Party Sites and Services.

    The App may link to third-party websites or services. Photo Scanner is not responsible for the content, goods, services, or policies of third parties. Your dealings with third parties are solely between you and the third party.

14. User Content; Availability.

    Photo Scanner does not guarantee availability or persistence of User Content. We may remove or disable access to Content that violates these Terms or applicable law.

15. Termination.

    Photo Scanner may suspend or terminate your access for any reason, including breach of these Terms. Upon termination, your rights to use the Service will end. Termination does not relieve you of obligations incurred prior to termination.

16. DISCLAIMER; NO WARRANTIES.

    THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND. TO THE MAXIMUM EXTENT PERMITTED BY LAW, Photo Scanner DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. Photo Scanner DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED OR ERROR-FREE. OCR, RECOGNITION, OR OTHER RESULTS MAY VARY AND Photo Scanner MAKES NO GUARANTEE ABOUT ACCURACY.

17. Indemnification.

    You agree to indemnify and hold Photo Scanner and its affiliates harmless from any claims, liabilities, losses, damages, costs, or expenses (including reasonable attorneys’ fees) arising from your use of the Service or violation of these Terms.

18. Limitation of Liability.

    TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL Photo Scanner BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE. Photo Scanner’s TOTAL AGGREGATE LIABILITY FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE SHALL NOT EXCEED ONE HUNDRED UNITED STATES DOLLARS (USD $100), EXCEPT WHERE APPLICABLE LAW REQUIRES A DIFFERENT LIMIT.

19. Disputes; Arbitration; Governing Law.
    1. Informal Resolution. If a dispute arises, you agree to first send a written notice describing the dispute to Photo Scanner at the contact email below and attempt to resolve the dispute informally.
    2. Arbitration Agreement. To the fullest extent permitted by applicable law, you and Photo Scanner agree to resolve disputes through binding individual arbitration (not class arbitration) unless you opt out as permitted below. Arbitration will be conducted under the rules of a recognized arbitration provider selected by Photo Scanner and will take place in a reasonably convenient location. The arbitrator’s award will be final and binding.
    3. Governing Law. Except where prohibited by applicable law, these Terms will be governed by and construed in accordance with the laws of the State of New York, U.S.A., without regard to conflict of law provisions.
20. Apple App Store Terms; Purchases through Apple.

    If you obtained the App from Apple’s App Store, you acknowledge that these Terms are between you and Photo Scanner only, and not with Apple. Apple is not responsible for the App or the content thereof. All in-app purchases and subscriptions are processed by Apple and are subject to Apple’s terms and policies. You agree that Apple has no obligation to provide maintenance or support for the App. For purchases made through the App Store, subscription management, cancellations, and refunds are handled through Apple; please refer to Apple’s support resources for assistance.

21. DMCA / Copyright Infringement.

    If you believe your copyright has been infringed in connection with the App or Service, please send a notice containing the information required by 17 U.S.C. § 512(c)(3) to the designated agent below. Photo Scanner will respond in accordance with applicable law.

22. Miscellaneous.
    1. Severability. If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full force and effect.
    2. Assignment. You may not assign your rights under these Terms. Photo Scanner may assign its rights without restriction.
    3. Survival. Sections concerning Ownership, License to Your Content, Disclaimers, Indemnity, Limitation of Liability, and Dispute Resolution survive termination.
    4. Entire Agreement. These Terms constitute the entire agreement between you and Photo Scanner regarding the Service and supersede prior agreements.
